ArmInfo. Members of the current Constitutional Court remained in their posts solely thanks to the coronavirus. Independent MP Arman Babajanyan expressed a similar opinion to ArmInfo.
"The situation in which constitutional justice is carried out not by legitimate judges, but by a , even looks ridiculous, not to mention the content. Moreover, this situation seems unacceptable. In this light, I personally see the need for its resolution, if not through a public referendum then through parliament, "he stressed.
As a result of the state of emergency, declared on March 16 for a month, the referendum scheduled for April 5 to adopt amendments to the Constitution to dismiss seven of the nine judges of the Constitutional Court is postponed. According to the current legislation, a referendum can take place no earlier than 60 days after the completion of the emergency situation.
Babajanyan is more than convinced that there is no influence of the postponement on the results of the referendum. According to his forecasts, with the overcoming of the coronavirus, the campaign in favor of "Yes" will continue from the interrupted place and will provide the expected and initially planned result.
At the same time, the MP considers the preservation of the existing constitutional crisis over the coming months unacceptable and threatening for the country. "In these very days, head of the Constitutional Court, Mr. Tovmasyan, does not even hide his intentions to overthrow the current government in his statements. Thus, there may be an invisible but strong organic relationship between the constitutional crisis and the coronavirus crisis and under conditions of uncertainty of the future of the country in connection with the coronavirus, it is unacceptable to have such a CC which, even indirectly, disputes the legitimacy of the decisions made," he emphasized.
The preservation of such a situation, according to the forecasts of the parliamentarian, is fraught with numerous, unmanageable risks. In such circumstances, the parliament, according to his estimates, not only can, but also must solve the problem of the Constitutional Court, the problem of threats associated with the Constitutional Court through voting in the shortest possible time.
