ArmInfo. General Prosecutor of Armenia Artur Davtyan believes that at this stage of the investigation of the March 1, 2008 case, the second President Robert Kocharyan, accused of overthrowing the constitutional order, should be under arrest, and with this petition he intends to speak at a meeting of the Court of Appeal today.
According to him, Kocharyan's actions on March 1, 2008 could in no way proceed from his official powers, since they were contrary to the Constitution. Davtyan also stated that in connection with the appearance of new details in the case, some previous court verdicts should be revised, as evidenced by the decisions of the European Court of Human Rights.
To note, the meeting of the Court of Appeal to review the measure of restraint against Kocharyan began yesterday and will continue today. Both yesterday and today, the Prosecutor General participates in the meetings, which is an unprecedented phenomenon in the Armenian justice system. Kocharyan himself is also present at the meetings. His defense demanded yesterday the disqualification of the presiding judge, promised surprises, and also declared that the charges were groundless and unmotivated.
