«Հայաստանի էլեկտրական ցանցերը» մտադիր է բողոքարկել կարգավորողի որոշումը

ՀՀ հանրային ծառայությունները կարգավորող հանձնաժողովը նախօրեին կայացած նիստում 15 միլիոն դրամով տուգանել է ՙՀայաստանի էլեկտրական ցանցերին՚ (ՀԷՑ): Մասնավորապես, հանձնաժողովը ՀԷՑ գործունեությունում հայտնաբերել է ՀԾԿՀ կողմից սահմանված մի շարք իրավական ակտերի պահանջների խախտումներ:


Խոսքը վերաբերում է Երևանի Ադոնցի 8 հասցեում բազմաբնակարան շենքի կառուցապատող ՙՄիկմետալ՚ ՓԲԸ-ին, որի հետ ՙՀԷՑ՚ ՓԲԸ-ն համաձայնության չի հանգել
կառուցված շենքում համապատասխան տարածքի օգտագործման պայմանների շուրջ, որտեղ
արդեն տեղադրել է ենթակայանի համար սարքավորում (հենց նույն շենքի
էներգամատակարարման համար):  ՀԾԿՀ որոշման համաձայն, 15 մլն դրամ տուգանք կիրառելու առիթ է հանդիսացել շենքի սեփականատիրոջ կողմից ՀԷՑ ՓԲԸ-ին
հասցեագրված առաջարկությունների գրավոր պատասխանի բացակայությունը և ՀԾԿՀ
ներկայացվող հաշվետվությունում այդ տվյալների արտացոլված չլինելը:


 



Ընկերությունն իր հերթին առարկել է իր գործունեության նման որակմանը և, համապատասխանաբար, իր նկատմամբ նշված տուգանքի կիրառմանը:  ՀԷՑ-ն իր առարկությունները և դրանց հիմնավորումները ներկայացրել է
ինչպես գրավոր` վարչական վարույթի շրջանակում, այնպես էլ բանավոր` նիստի
ընթացքում: ՙՀԷՑ՚ ՓԲԸ կարծիքով, ՙՄիկմետալ՚ ՓԲԸ և ՙՀԷՑ՚ ՓԲԸ միջև առկա է գույքային հարաբերությունների հնարավոր պայմանների վերաբերյալ քննարկում (տարածքի վարձակալություն կամ
ձեռք բերում), որոնք անմիջականորեն ՀԾԿՀ իրավական ակտերի կարգավորման առարկա չեն: ՀԾԿՀ որոշման մեջ նաև նշվում է ընդունված որոշումն ինչպես վարչական կարգով /ՀԾԿՀ-ում/, այնպես էլ դատական կարգով /ՀՀ Վարչական դատարանում/ բողոքարկելու ՙՀԷՑ՚ ՓԲԸ իրավունքի մասին: Ընկերությունն իր իրավունքի իրացման վերաբերյալ որոշում կկայացնի ամենամոտ ժամանակներս:
