ArmInfo.The Investigation Committee of Armenia completed a preliminary investigation in a criminal case initiated into abuse of official position by officials of the Meghri community. The former head of the community and his former deputy charged.
On July 19, 2018 a criminal case was initiated in the investigation department of the National Security Service of the Republic of Armenia under Part 1 of Art. 308 of the RA Criminal Code, the preliminary investigation of which was conducted in the Syunik Regional Investigation Department of the RA Investigative Committee.
The investigation obtained evidence that the head of the community, who held the position from November 2012 to September 2016, being an official, by prior agreement with his deputy, deliberately committed actions that were clearly beyond the scope of his authority established by the Law of the RA and other regulatory legal acts, and caused substantial harm to the rights of individuals, as well as the legitimate interests of the community.
According to the data obtained during the pre-trial proceedings, during his tenure, the head of the urban community Meghri and the deputy head of the same community, the director of the Meghri Foundation, by prior agreement, intentionally violated the decision of the Council of Elders based on a June 18, 2015 government decision. Megri on granting fire victims on June 13, 2015 in the residential building N7 on Zoravar Andranik Street, as well as to young families registered in Meghri Mayor's Office and in need of an apartment, for free use of the building Megri infectious diseases hospital and a land plot allocated for its use and maintenance, as well as the Megri Regional Medical Center CJSC, which is owned by it.
In particular, without actually studying the holistic data on registering young families in need of an apartment, without organizing the process of allocating apartments by drawing lots and concluding a commission, ignoring the imperative requirements of the above government decision to donate apartments to these families for reconstructing the premises provided free of charge in residential premises, including the list of beneficiaries receiving flats and the provision of flats, from 8 young families chosen by the government's decision to artire demanded transfer to the account of the Fund 26.000-36.000 AMD per 1 sq. m provided housing. And 14 people who did not need an apartment and / or were not considered young and unmarried were provided with apartments.
In addition, garages located at the same address and land plots of 31.3 square meters donated for the same purpose.31.3 square meters, 32.8 square meters, 35.5 square meters, 34.1 square meters, 28.8 square meters and 31.3 square meters were sold to 6 families, respectively, for 385.000 drams, 330.000 drams of RA, 275.000 drams of RA, 330.000 drams of RA, 247.500 drams of RA and 385.000 drams.
As a result, the families affected by the fire refused to pay and receive the apartments due to them free of charge, and 8 young families in need of housing paid a total of 17.556.710 drams for receiving the apartments due to them free of charge and14 families who are not entitled to free housing received apartments. Based on the evidence obtained, the former head of the city community Meghri and his former deputy were charged under part 1 of article 309 of the RA Criminal Code.
The criminal case with the indictment was sent to the prosecutor supervising the legality of the preliminary investigation.
