ArmInfo.The lawyers of the entrepreneur Samvel Mayrapetyan on January 2 appealed to the European Court of Human Rights with a request to require the Armenian authorities to return passport to their client as an interim measure. This is stated in a statement issued by a group of lawyers of Samvel Mayrapetyan.
The statement also notes that the lawyers are also asking the ECHR to insist that the Armenian authorities give Mairapetyan the opportunity to leave the country for Germany for urgent treatment, as the life and health of their client is at risk. "In turn, on January 3, the ECHR made a decision on the use of an interim measure and addressed questions to the Armenian government, demanding to inform immediately on the basis of which legal grounds the Special Investigation Service of Armenia withholds Mairapetyan's passport.
"While the international authority is ready to make a decision in connection with a citizen whose life and health are under threat, the domestic state body, which is designed to protect the life and health of its citizen or at least not interfere with its realization of this right, prefers not only to neglect the statements of the citizen, but also does not fulfill its duties before the law, "the lawyers said in a statement.
To note, Mayrapetyan's lawyers have already raised the issue of providing a passport and the need to treat their client in Germany on December 30th, however, the SIS has responded to this statement with a verbal refusal.
To recall, on December 27, the court of general jurisdiction of Yerevan granted the request of Mairapetyan's lawyers, and the entrepreneur was released on the security of 30 million drams. On October 9, Mairapetyan was charged on the grounds of Article 38-311 of the Criminal Code of the Republic of Armenia (assistance in receiving a bribe). Earlier, the Prosecutor General's Office refused to apply for a change in the measure of restraint in relation to Samvel Mayrapetyan under personal guarantee. Entrepreneur Samvel Mayrapetyan is considered a person close to former President of Armenia Robert Kocharyan. He is engaged in the construction of luxury real estate, is the president of the company "Toyota Yerevan", he owns the broadcasting company H2. To recall, on November 29, the court granted the petition of the SIS and extended the arrest of Mairapetyan for another two months.
