ArmInfo.The Armenian side positively perceived the interim decision of the European Court of Human Rights in connection with the aggravation of the situation in Nagorno-Karabakh.
As the representative of Armenia to the ECHR Yeghishe Kirakosyan noted at a briefing on September 30, the ECHR satisfied Armenia's request for the application of interim measures in connection with the aggravation of the situation in Nagorno-Karabakh. It is important, Kirakosyan continued, that the court took into account the statement and facts of the Republic of Armenia, without even addressing a request to the other side, in this case, to Azerbaijan, for urgent receipt of additional information or comments. The last time the court twice resorted to such a measure in relation to Ukraine. Despite the fact that the ECHR decision is directed to all the warring parties, as Kirakosyan noted, it is important that the ECHR's appeal is based on the facts presented by the Armenian side. In the next 1-2 days Armenia will submit new data to the court. Now the Armenian will wait for a response from the government of Azerbaijan, after which it will make an additional statement. To remind, the European Court of Human Rights (ECHR) ruled on Yerevan's request for interim measures in connection with the aggravation of the situation in Nagorno- Karabakh. So, according to the message of the ECHR, received by ArmInfo, on September 29 a session on this issue was held, in which 7 judges took part. "Considering that the current situation creates risks for a serious violation of the Convention, the ECHR decided to apply Article 39 of the rules of the court. In order to prevent such violations and in accordance with Rule 39, the Court called on Azerbaijan and Armenia to refrain from any measures, in particular military actions, which may entail violations of the rights of civilians enshrined in the Convention, including endangering their lives and health, as well as respecting their obligations under the Convention, especially with regard to article 2 (right to life) and article 3 (prohibition of torture and inhuman or degrading treatment or punishment) of the Convention. The court also invited both contracting parties to inform it as soon as possible about the measures taken to fulfill their obligations, "- said in the decision of the ECAC. It is also noted that measures under Rule 39 of the Rules of Court are taken in connection with proceedings before the Court, without prejudice to any subsequent decisions on admissibility or merits. The communication also emphasizes that the Court will only grant such requests in exceptional cases where the applicants would otherwise have faced a real risk of irreversible harm.
As ArmInfo previously reported, on September 27, the Armenian representation at the ECHR reported that Yerevan had applied to the European Court of Human Rights with a request to apply interim measures against Azerbaijan in connection with the aggravation of the situation in Nagorno-Karabakh.
